Marek Nitoslawski is the leader of Fasken Martineau's Technology and Intellectual Property national practice group. He focuses his practice on intellectual property, media and communications law. He provides strategic and timely advice to clients including multinational corporations, broadcasters, on-line music distributors and other on-line content users, and helps businesses and individuals optimize the protection of their intellectual property assets. Marek has successfully handled litigation involving patent, copyright, trade-mark, trade dress and trade secrets; and unfair competition before the Québec courts, the Federal Court of Canada at the trial and appellate levels, and before the Supreme Court, as well as before various administrative tribunals including the Copyright Board and the Canadian Radio-television and Telecommunications Commission (CRTC). In 2004, Marek secured the highest monetary award to date for copyright infringement in Canada on behalf of his client Équipe de Recherche Opérationnelle en Santé Inc. (EROS). He also regularly counsels leading-edge technology ventures on questions of on-line copyright and other issues related to or arising from creating content and doing business on the Internet. Broadcasters, on-line music distributors and other clients turn to Marek for his extensive knowledge of issues relating to the use of content in traditional and on-line media, including branding issues and trade-mark use on the Internet. A frequent and popular speaker on intellectual property issues at various conferences and seminars, Marek has been recognized as a leading practitioner in Intellectual Property by Lexpert and by Canada's Best Lawyers.
