Mining - Global Mining

The 2008 Edition of the International Who's Who of Mining Lawyers for the fourth year running ranks Fasken Martineau as the number one firm worldwide for mining legal expertise. "Fasken's continuing success is reflected in the consistently positive feedback we received, recognising the firm's exceptional individual and collective talent.  We have no hesitation in once again declaring Fasken Martineau to be the leading firm in the world in this area" states Callum Campbell, Editor in Chief of Who's Who Legal, when recognizing Fasken Martineau's achievement of this award.

Lexpert, an independently published service that identifies and ranks leading Canadian law firms and practitioners, has recognized Fasken Martineau and nominated fourteen of its partners as leading practitioners in the mining sector (the most of any firm).

Fasken Martineau has over 150 years of experience in the mining industry, domestically and internationally. The lawyers in the Global Mining Practice are particularly experienced in addressing the international dimensions that characterize many mining industry transactions today, and we are the only law firm globally with offices in each of the key mining finance centres of Toronto, Vancouver, London, and Johannesburg.  We represent not only mining companies, but financial institutions and investors, as well as governments, industry service providers and others participating in mining and mining related activities. We have significant experience in all legal aspects of the mining industry including listings in Canada and London, equity financings in the Canadian and international financial markets, project finance for mining projects located around the world and other debt financings. We also have deep, tactical knowledge of mine construction agreements, exploration and development agreements, mine permitting and closure plans, mining litigation, resource taxation, environmental compliance and aboriginal issues.

The depth of the firm in all areas of law allows the core members of the Global Mining Group to draw upon other specialists in the firm, such as those who devote their practices to environmental, aboriginal or regulatory law, or those experienced in tax planning or dispute resolution. Both civil law and common law practitioners in the firm are available, as transactions dictate.

Typical commercial transactions in which Global Mining Group members would be involved include options and earn ins, joint ventures and shareholder agreements, acquisitions and dispositions, royalties and mine construction and mine operating agreements. In addition, international mining projects demand our skills in such complex areas as structuring transactions to promote tax efficiencies, reduce exposure to political and regulatory risk and facilitate financing. Mining finance is an important dimension of the group's services and includes private placements, public offerings, project debt financing, forward sales and other hedging transactions.

On an ongoing basis, members of the Global Mining Group monitor industry developments generally, as well as the legal and regulatory changes that could affect mining interests. We participate in industry associations, conferences and seminars to ensure that our knowledge of industry players and material transactions is continually updated. We believe that our industry contacts, both domestically and internationally, are second to none among Canadian and international law firms.
