A June 2008 article on how the law is being leveraged to help prevent and mitigate theft of corporate intelligence features partner Lisa Abe.
Ms. Abe is quoted extensively on ways in which outsourced divisions of a corporation may consider protecting themselves from corporate espionage or the aggressive harvesting of competitive intelligence.
"From the perspective of offshore outsourcing, it's a much bigger risk because the personnel in those countries, their standard of living is much lower than ours, and they may be bale to gain much more by disclosing and breaching contracts and not suffer the same repercussions as they would here," says Ms. Abe.
"It's very important they have in place confidentiality agreements with the outsource provider. Especially those that have subcontractors...Corporate Counsel has to watch out for how confidential information is defined and what the exclusions for disclosure are."
