André Durocher practices in the areas of class actions, environmental law, energy law and aboriginal law.

He has defended clients in class actions in the following areas of law:

  • Environmental law (dust and particulate matters, noise and vibrations, noxious odours, contaminated soil, air pollution)
  • Aboriginal law (sexual abuse) 
  • Consumer protection law (false or deceptive advertising) 
  • Competition law (before both the Superior Court and the Federal Court of Canada) 
  • Product liability (drugs, medical devices, car parts, truck engines) 
  • Municipal law (municipal taxes, civil liability following police interventions) 
  • Food law (deceptive advertising about the beneficial health effects of a food product) 
  • Pension plans (pension fund surplus)

He has represented pharmaceutical laboratories, railways, airlines, chemical products manufacturers, chicken processing plants, rendering plants, municipalities, metal manufacturing industries, car parts manufacturers and motor racing organizations.

In environmental law, he has defended businesses in civil suits, such as injunctions, judicial review applications or cost recovery claims. He has represented businesses in penal actions for offences under environmental protection laws and municipal by-laws or regarding administrative remedies launched by government authorities, such as applications to revoke environmental permits or orders from the Minister of the Environment.

In energy law, he has represented public utility services based outside of the Province of Québec before the Régie de l'énergie in rate hearings and complaints against Hydro Québec in its role of Transmission Provider under the Hydro Québec Open Access Transmission Tariff.

In aboriginal law matters, he has represented energy and resources companies in injunction and land claim proceedings.

He co-authored the class action section of the annotated Code of Civil Procedure published by Lexis Nexis. He is also co-author of a fascicule on authorizations to institute a class action in the second compilation on civil procedure in JurisClasseur Québec.
