2009 was a significant year in Canadian competition law. Major amendments to the Competition Act were enacted. There were also noteworthy court decisions in respect of civil actions for damages under the Competition Act, and a significant decision of the Competition Tribunal in respect of the refusal to deal provision. In addition, the Canadian Competition Bureau published important enforcement policy documents including in respect of the new competitor agreements provisions of the Competition Act. Important amendments to the Investment Canada Act were also enacted, including the introduction of a national security review mechanism, and there were a number of highly-publicized matters including in relation to U.S. Steel. Our bulletin also covers certain competition law developments in the European Union, France, the United Kingdom and South Africa.
