Human rights law requires that employees suffering from disabilities be accommodated in the workplace. This simple proposition, however, creates numerous issues for Employers. In this series of four separate workshops, the seeming maze of requirements, dictated by arbitrators, human rights tribunals and the courts, will be addressed.

While each workshop is a self-contained session focused on a particular topic and area, the four sessions link together to provide a comprehensive overview of the current law in this area. Participants may choose to attend all four workshops, or just those workshops which are of most immediate interest.

Workshop #2: Information and Privacy Concerns Associated with the Duty to Accommodate

  • How do privacy laws apply to the duty to accommodate?
  • What are the legal obligations in handling employee personal health information and are there special considerations?
  • Obtaining the information you need – what can and cannot be requested?
  • Who should provide the information – doctors or employees?
  • What are your responsibilities respecting record keeping? And what happens to the information once the employee has been accommodated?
  • Third party insurer or self-insured - does it make a difference?
  • Are there consents and authorizations that can protect employers?
  • To what extent can information be shared within the organization, with independent medical examiners, or with the employee?
