Employers Duty to Accommodate Workshop #1: Overview and Update

Human rights law requires that employees suffering from disabilities be accommodated in the workplace. This simple proposition, however, creates numerous issues for Employers. In this series of four separate workshops, the seeming maze of requirements, dictated by arbitrators, human rights tribunals and the courts, will be addressed.

While each workshop is a self-contained session focused on a particular topic and area, the four sessions link together to provide a comprehensive overview of the current law in this area. Participants may choose to attend all four workshops, or just those workshops which are of most immediate interest.

Workshop #1: Overview and Update on the Duty to Accommodate

  • What does the most recent case law have to say about the duty to accommodate?
  • What are the emerging trends?
  • When do attempts at accommodation reach the point of undue hardship?
  • What effect does a collective agreement have on the duty to accommodate?
  • What are the employee's obligations when seeking accommodation?
