Kerry decision featured in Pensions & Investments

In a recent article, Pensions & Investments magazine reported on the important Ontario Court of Appeal ruling in the Kerry (Canada) Inc. vs. DCA Employees Pension Committee case.

The court ruled on the issues of pension plan administration expenses, contribution holiday and the conversion of the employees' pension plan from a defined benefit plan to a defined contribution plan. Kerry was represented by partners Ron Walker and Christine Tabbert of Fasken Martineau.

The ruling is "a correction," says partner Peggy McCallum, who is quoted in the article. "It brings the law back to where employers thought it was before (this case). It's an important case from the perspective of employers and plan sponsors because it clarifies their rights in converting and maintaining a converted plan. Plan expenses and the contribution holidays … were the two important developments in the case. And they're the ones that will have lasting benefit for employers."
