Arnauld Achard primarily practices in the field of financial law, with a particular focus on debt and equity-linked markets, investment funds, securities law, and cash management products. He also assists in the restructuring of bank debt.
During his career, Arnauld has built up a significant practice in Morocco, where he advised the Ministry of Economy and Finance of the Kingdom of Morocco, namely with respect to its international debt issuances and hedging policies
Before joining Fasken Martineau in 2011, Arnauld practiced with Simmons & Simmons in Paris and previously led Clifford Chance's capital markets and derivative instruments group in Paris. Arnauld began his career as an assistant portfolio manager with UAP and as an auditor with Ernst & Young.
Arnauld's capital markets law expertise includes:
- Debt Securities: Assistance regarding the distribution of Eurobonds, negotiable debt securities and other highly leveraged debt securities
- Derivative Instruments: Assistance with the implementation of interest rate and cross currency swaps, credit derivatives, equity and commodity derivatives; and with the distribution of warrants or negotiable securities linked to stock markets or other indexes
- Debt-like Securities: Counsel regarding the distribution of convertible, exchangeable, redeemable and complex bonds and of regulatory securities for financial institutions
- Optimization Products: Involvement in the structuring of documentation for international balance sheet optimizing structures
- Structured Products: Involvement in the implementation of highly complex products, such as repackagings, issuance of hybrid securities such as collateralized bond obligations and collateralized debt obligations
- Securitization: Involvement in domestic and international securitization transactions involving a wide variety of underlying assets such as mortgage loans, credit card debt, commercial debt and aircraft.
His investment funds law expertise includes:
- Development, structuring and amalgamation of all types of investment funds
- Contractual aspects of such funds, such as security lending, options and other derivative instruments intended for funds
In securities law, Arnauld is involved in transactions stemming from primary equity markets, and distribution of equity and debt-like securities (particularly OCEANEs, ORANEs and ORNANEs). He is also involved with derivative instruments whose underlying assets are made up of such securities.
Working with cash management products, Arnauld assists treasurers of large companies regarding the implementation of cash centralizing, syndicated credit, asset financing, treasury stock, etc.
