Consumer Protection

Both the provincial and federal governments in Canada have enacted complex legislation setting out consumer product advertising, labelling and packaging requirements; requirements for the import, export, advertising and sale of various foods and drugs; and requirements respecting the manner of advertising of services. There are distinct differences in this legislation nationally, particularly for products and services offered in Quebec, and failure to comply can result in serious penalties.

Members of our regulatory group assist businesses of all sizes in navigating and complying with these laws. We help clients to avoid regulatory sanction and respond to regulatory inspections and investigations of alleged infractions in all provinces and territories of Canada.

Recent representative experience is as follows:

  • Counsel to manufacturer of bottled water in relation to labelling and advertising requirements for products offered for retail sale in British Columbia
  • Counsel to U.S. clothing and sporting gear manufacturer in relation to sale and advertisement of its products across Canada
  • Provided advice to importer of food products from China for re-packaging and sale to Canadian distributor of products across Canada
