Development of jurisprudence regarding the prescription applicable to claiming vacant successions held by Québec entities on behalf of several heirs
Since 2004, Mtre Aylwin has repeatedly represented the heirs of vacant successions in order to establish their right to claim their share of a succession held by the Curateur public du Québec or the Ministère du Revenu du Québec, as appears in particular from the following decisions: S.S. et al. v. Curateur public du Québec, February 23, 2004; L.C. v. Curateur public du Québec, May 13, 2004; The Estate of Alexander Greig Thom et al. v. The Estate of Alexander Théodore Thom et al., September 18, 2007; Mason et al. v. Sous-ministre du revenu du Québec, April 30, 2009 and Fourie et al. v. Sous-ministre du revenu du Québec, August 5, 2009.
