Social Networking: Guidelines for HR Professionals | Facilitated by Lorene Novakowski | Monday, June 27, 2011

YouTube. Twitter. Facebook. LinkedIn. This workshop will consider the many opportunities and risks for employers created by social media and social networking. Employers must understand the scope of the right to discipline employees for misuse of social media both at work and off-duty, be aware of the risks of using social media for hiring and termination decisions, understand the limits of the right to monitor employee use of social media both at and away from the workplace, know how and when to obtain disclosure from social networking sites and know what should be included in a social media and social networking policy for employees. This workshop will provide guidelines for all of these issues and provide model policy language.

*Medical Information and Privacy | Facilitated by Lorene Novakowski | Thursday, November 3, 2011

The balancing of interests – management's right to obtain medical and health information/reports/certificates versus the employee's right to privacy – will be examined in the context of short absences, disability claims, accommodation requests and excessive absenteeism. This workshop will provide a review of the most recent cases, and best practices for the process of obtaining information, including when to ask for the FCE or the IME, privacy compliant consent language, and when/how to disclose information to unions or allow use by managers. The appropriate employer response when employees refuse to provide information will also be outlined.

*How to Design and Implement an Effective Attendance Management Program | Facilitated by David McDonald and David Wong | Thursday, November 24, 2011

What options exist for employers in dealing with chronically absent employees? The legal and practical issues surrounding this topic will be discussed in the workshop. Tips for handling both culpable and non-culpable absenteeism, when and how to apply the duty to accommodate in relation to absenteeism, building a case for discipline or termination in appropriate circumstances, and the features of an effective attendance management program will be presented.

*Managing in a Union Environment | Facilitated by Charles Harrison | Friday, September 30, 2011

Since Fasken Martineau pioneered human resource training sessions several years ago, this has been one of our most popular topics. In this session, fundamental concepts related to managing a union workforce will be reviewed. Topics include understanding the employer's right to direct and manage its union workforce, conducting fair and effective investigations into misconduct, utilizing "progressive discipline" in the face of work-related misconduct on the part of a union employee, and dealing with non-culpable problems where there is no fault on the part of the union employee (such as innocent and excessive absenteeism). Attendees will learn how and when to discipline for misconduct as well as how to manage a case that can be successfully defended at arbitration.
