Francesca Boateng-Muhammad is an Associate at Fasken Martineau LLP and a member of the Technology and Intellectual Property and Life Sciences practice groups.
Francesca advises clients on a wide range of intellectual property, regulatory and transactional matters in the life sciences sector. She spent a considerable period of time seconded to the contracting and outsourcing development team of a large pharmaceutical client company. Francesca has experience in representing commercial clients on matters of intellectual property and technology including trade marks, copyright, confidentiality and licensing. Her experience also includes drafting commercial agreements and conducting due diligence investigations for mergers and acquisitions.
Francesca has advised in preparing and negotiating confidentiality agreements, material release agreements, a range of clinical trial related agreements (including agreements relating to clinical research organisations, investigators, investigational sites, data management, IVRS, analytical services, radiology, pharmacy, storage and clinical trial packaging), consultancy agreements, supply and distribution agreements, research and development agreements, collaboration agreements, contract manufacture and technical agreements and other general commercial documents.
Francesca also has extensive experience advising on issues of patient informed consent, clinical trials and research, appointment of medical staff, outsourcing, protection of intellectual property, access to information and confidentiality issues, ownership and publication of data arising from clinical trials, risk management related issues such as limitation of liability, indemnities and insurance, all for multi-national corporations.
For some years now, Francesca has also advised on music related contracts including recording, publishing and management having been actively involved in the music careers of a number of singer/songwriters and musicians.
Francesca contributed to the preparation and publishing of the firm's "Legal Guide to the Internet". She also assisted in the finalising of the publication "Clinical Outsourcing in the Pharmaceutical Industry" by Paul Ranson (Bridgehead Publishing) and has written articles on "Artist Management" and "Music Piracy" for the firms' website. She has also given and prepared material for external seminars on Contract Manufacture and Technical Agreements and lectures extensively on agreements in contract research/outsourcing.
