Counsel for the Plaintiff, the stewardship agent for manufacturers of beverage containers, in a claim against a depot and transporter alleging that the defendants materially overstated the number of beverage containers that they collected and delivered to Encorp and, accordingly, were paid excess fees to which they were not entitled. Appeal by the defendants is pending.
The Supreme Court of British Columbia dismissed a proposed $130 million class action against operators of the beverage industry recycling system. The Court of Appeal upheld the decision of the Supreme Court. Leave to appeal to the Supreme Court of Canada was denied.
The Defendant Horne fraudulently persuaded the Plaintiff to provide him with funds which he represented would be invested in an annuity contract to be issued by the Defendant Canada Life Assurance Company. The funds were pocketed by Horne. Acted for the Defendant Canada Life in a claim brought by the Plaintiff alleging that Canada Life was vicariously liable. The claim was dismissed.
