The latest B.C. Supreme Court decision regarding the duty to consult and accommodate, Apsassin et al. v. B.C. Oil and Gas Commission et al., 2004 BCSC 92, was released January 27, 2004.

Mr. Justice Cohen dismissed the Saulteau First Nation's application to quash a decision by the British Columbia Oil and Gas Commission, granting Vintage Petroleum Canada, Inc. permission to construct an exploratory well site, with associated roads and other infrastructure, in the traditional territory of the Saulteau First Nation.
