Cases in the federal and British Columbia court concern a three-year trial resulting ultimately in a partial judgment and settlement concerning claims of mismanagement and breach of fiduciary duty against the federal crown for the management of the False Creek Indian Reserve in Vancouver.
The BC proceedings concerned the reversion of the CPR Railway lands in the False Creek Reserve to the Crown and whether those lands upon being returned to the Crown were held on trust for First Nations. In the result, the Crown was successful in having the Band and Railway right-of-way returned to the Crown and was held to hold that title on trust for the Squamish First Nation.
