Claude Thomson and Gideon Forrest acted for Lovat Tunnel, who had been added to a multi-party case brought by Canadian National Railway concerning certain insurance contracts. We brought an application to have the claim against our client sent to arbitration pursuant to an arbitration clause in a contract, rather than have the case tied up with other proceedings. This decision is one of the leading cases on whether to stay a court action in favour of arbitration, having been cited in two dozen cases.
