Successfully defended an action under a long-term disability policy on a claim for 21 years disability insurance and bad faith brought under an open ended proof of loss provision. Following a 3 week trial the Court of Queen's Bench dismissed the action ruling that the Plaintiff had failed to file his claim within a reasonable time of realizing his disability and that there was no bad faith on the part of insurer in evaluating the claim.
