Appeared as counsel on behalf of MacMillan Bloedel Limited (MBL) in a complex civil fraud action. The first named defendant, a manager of MBL, held an undisclosed interest in a company to whom the defendant sold MBL's excess log supply, which in turn were re-sold on the Japanese export market. It was determined that MBL would not have sold its logs on this market due to government regulation. Notwithstanding this, MBL obtained judgment of approximately $9 million for breach of fiduciary duty and knowing participation in that breach together with shares in a private company valued at $4 million through a complicated equitable tracing remedy.
