Quintette Coal Limited v. Bow Valley Resources Limited, 1987-1989
Appeared as counsel on behalf of the defendant in a construction action involving the design, supply and construction of a state of the art overland conveyor system that transported the plaintiff's coal from its open pit mine over 13 kilometres of mountainous terrain to the plaintiff's coal processing plant. The claims advanced totalled approximately $40 million. The action also resulted in the defendant bringing a collateral action in bad faith against the defendant's insurer. The action eventually concluded with a complex settlement which included the assignment of the defendant's action in bad faith against its insurer to the plaintiff.
