Trizec v. Ellis Don, Agra Industries Inc. et al, [1998] 227 A.R. 1, (1998) 42 C.L.R. (2d) 1 (Defence of Geotechnical Engineers in a Construction Dispute)
Successfully represented the geotechnical engineers, Hardy BBT Ltd., in an action in the Court of Queen's Bench brought by Trizec for breach of contract and professional negligence in the soils investigation at Bankers Hall in the City of Calgary claiming damages in excess of $21 Million plus interest. Following a trial of 145 days duration and extensive written submissions the action was dismissed against both defendants.
