Karl Delwaide

Karl Delwaide is a partner with Fasken Martineau, and is a founder and current leader of the firm's National Practice Group on Privacy and Information Protection. With extensive experience and successes in complex litigation, he is widely recognized as one of the few Québec lawyers with broad and significant knowledge of the courts and tribunals in the privacy and information protection area. To that end, Karl was commissioned by Mtre Jennifer Stoddart, Canada's Federal Privacy Commissioner, to co-author a book on 10 years of case law entitled, "Learning from a decade of experience: Quebec's Private Sector Privacy Act," published in August 2005. Mr. Delwaide represents private enterprises and public organizations in regard to all issues dealing with privacy, the protection of information and freedom of access to information. This quickly emerging area of law includes all information held or managed by an organization, such as financial, commercial or strategic information regarding the organization or its clients, as well as the protection of privacy and of personal information, including its use on the Internet. He has also advised clients (including public bodies) in matters related to the installation and use of cameras for security and safety purposes in light of the Québec Charter of Human Rights and Freedoms, the Civil Code of Québec and the Québec Privacy statutes. He regularly acts in these matters before the Commission d'accès à l'information and other tribunals or courts, including the Federal Court. Mr. Delwaide also devotes a significant amount of his practice to administrative and regulatory law, including successfully arguing judicial revisions before the courts. Clients as well as co-counsels in Canada and the United States turn to him for his regulatory experience in matters dealing with privacy and protection of information, as well as in other matters. His representations in this area range from acting for the agricultural trade (buyers/processors) to the transportation and pharmaceutical industries. Mr. Delwaide also advises film and television producers and broadcasters in cases of libel, slander, defamation and other issues that could potentially affect the privacy and reputation of an image.
