On August 7, the Supreme Court of Canada, in a landmark decision, dismissed the appeal of Nolan v. Kerry (Canada) Inc.  The case arose following Kerry Canada's decision to restructure its employee pension plan by converting it from a defined benefit (DB) to a defined contribution (DC) plan, and to pay plan expenses from the pension fund.  Fasken Martineau represented Kerry Canada.
