Major Court of Appeal victory for Fasken Martineau's client IATA
December 8, 2011
Toronto (Canada) – Fasken Martineau, a leading international business law and litigation firm, is pleased to announce that the Court of Appeal for Ontario upheld the trial judgment favourable to the firm's client, the International Air Transport Association (IATA), in a litigation with Sabre Inc.
The ruling confirms the major trial decision that came down last January which dismissed Sabre's claims that the IATA PaxIS products violated confidentiality obligations. The trial judge categorically ruled that IATA's development and marketing of PaxIS had not breached any confidentiality obligations to Sabre. The result was that IATA could continue providing its clients with PaxIS, allowing them to operate with cost-effective and competitive products.
A team of Fasken Martineau lawyers composed of
Robert Harrison,
Paul Monahan and
Emmeline Morse represented IATA in the dispute.
Robin Roddey provided legal research support to the team.
"The Court of Appeal confirmed that our client has been handling and using electronically stored data within the confines of the law," said co-counsel Robert Harrison. "We are delighted that IATA will be able to continue marketing its airline industry business intelligence product."
"We have been representing IATA in this hard fought litigation for more than five years. We are proud of our representation of IATA and pleased that the highest Court in Ontario has completely vindicated our client's position," said co-counsel Paul Monahan.
