Tremblay v. Gagnon 2003 (QC. v.S.)

Mtre Dion successfully proved that Mr. Gagnon had transferred the file to a notary and that, consequently, he had no obligation to provide a rendering of account to Plaintiffs.

The action in rendering of accounts against the ex-officio Defendant failed. He therefore is not obliged to prove sound administration of the succession, which would have been very difficult, as he had not taken the file back from the notary since 1992.
