Penalties, prosecutions and orders: Amendments to the Environment Quality Act to reinforce compliance in force as of November 4, 2011

The modifications were adopted by the Quebec National Assembly on October 4, 2011. Generally, the modifications provide for significant measures relating to enforcement of the Environment Quality Act, specifically:

- The introduction of administrative penalties;
- Significant increases in fines imposed on prosecution and conviction for quasi-criminal offences;
- Changes to the officers' and directors' liability regime;
- Extending the legal prescription period;
- Broader order powers for the Ministry; and
- Creation of public registers which contain information relating to convictions and administrative penalties.

 
These amendments will change the way environmental legislation in Quebec is enforced.
