Huy Do and Antonio Di Domenico co-authored an article outlining the circumstances of the R. v. Nixon decision and discussing the Supreme Court's analysis, with a focus on the issues of prosecutorial discretion and the evolution and present state of the abuse of process doctrine and the Canadian Charter of Rights and Freedoms (the "Charter"). It concludes with an analysis of the implications of Nixon for competition matters.
