R. v. Rothmans (2010), NBQB 381 leave to appeal to the New Brunswick Court of Appeal refused (2011) CanLII 20626 (NBCA)
Co-counsel for the plaintiff Her Majesty the Queen in Right of the Province of New Brunswick in response to a motion by four tobacco industry defendants to stay the action on the basis that the New Brunswick Court lacked jurisdiction. The motion was dismissed and jurisdiction upheld. The New Brunswick Court of Appeal refused leave. The defendants are seeking leave to appeal to the Supreme Court of Canada.
