Leslie Milton acted for the Commissioner of Competition in this successful appeal of the Competition Tribunal's decision dismissing the Commissioner's application for a remedy under the abuse of dominance and exclusive dealing provisions in respect of a loyalty rebate program implemented by Canada Pipe.
This is the first abuse of dominance case in Canada involving a loyalty rebate program and the first time that an appellate court has considered the abuse of dominance provisions of the Competition Act.
Leave to appeal to the Supreme Court of Canada is currently being sought.
