Defending 8PM Chemist Limited on an interim injunction application brought against it by Eli Lilly on the basis of trade mark infringement by the receipt in the UK of pharmaceuticals for onward postage to patients in the US. The injunction was successfully overturned on appeal and summary judgment against Eli Lilly obtained as there was clear authority from the European Court of Justice that the transit of goods through the European Union under a customs supervisory procedure did not amount to import for trade mark purposes. 8PM was co-represented by intellectual property consultant, Anna McKay.
