International Dispute Resolution and Arbitration

Our International Dispute Resolution Group is comprised of lawyers from each of our eight offices, including representation in London.  We service clients who are involved in commercial disputes around the world, including international commercial arbitrations, investment disputes under the NAFTA and bilateral investment treaties and international trade disputes.  Members of our Group are regularly retained to represent clients in international disputes.  Certain of our members have extensive experience acting as arbitrators or mediators in a broad range of international disputes.  We are able to assist our clients in English, French and Spanish.

This Group works closely with our other specialty practice groups to provide dispute resolution services to parties from or in dispute in various parts of the world.  We actively participate in many leading dispute resolution organizations, including:

  • The International Chamber of Commerce and its Canadian National Committee;
  • The London Court of International Arbitration;
  • The American Arbitration Association;
  • The Chartered Institute of Arbitrators;
  • The Institute for Transnational Arbitration; and,
  • The ADR Institute of Canada.

Senior members of our Group have acted as arbitrators in a broad range of international disputes including institutional (ICC, LCIA, AAA, ICSID, and BCICAC) and ad hoc and UNCITRAL arbitrations:

  • Sole arbitrator in international distributorship, joint venture and sale of goods disputes involving parties from the US, Japan and Canada.
  • Chairman of a three-person arbitral tribunal in international sales disputes.
  • One of three jointly-selected arbitrators in large ICC and AAA international licensing and intellectual property disputes involving parties from the United States and Japan, and the United States and Germany.
  • Chair of arbitral panels in various domain name disputes.
  • Mediator in an international construction dispute involving a large hydro electric project in Latin America.
  • Member of five-person binational panels under Chapter 19 of the NAFTA dealing with disputes regarding the alleged dumping of products and material injury determinations.
  • Various appointments, including chairmanships, have been conducted entirely in Spanish or French.
  • Design and drafting of arbitration and mediation clauses and dispute resolution systems.
  • Advice and assistance to clients on strategy and preparation for arbitrations and mediations.
