The Dr. Peter AIDS Foundation applied for leave to intervene in the appeals from the orders of Mr. Justice Pitfield, where he declared that ss. 4(1) and 5(1) of the Controlled Drug and Substances Act, S.C. 1996, c. 19, are inconsistent with s. 7 of the Charter of Rights and Freedoms and of no force and effect.
There was also a cross-appeal on Pitfield J.'s finding on the division of powers issue. The Foundation was granted leave to appeal.
The appeals were heard April 27-29, 2009 and the Court of Appeal has reserved judgment. Andrew Nathanson and Maia Tsurumi represented the Dr. Peter AIDS Foundation.
