On August 7 the Supreme Court of Canada issued a landmark decision in Nolan v. Kerry (Canada) Inc. upholding the actions of the company in maintaining its employee pension plan. The case arose following Kerry Canada's decision to restructure its employee pension plan by converting it from a defined benefit (DB) to a defined contribution (DC) plan and to pay plan expenses from the pension fund. Fasken Martineau represented Kerry Canada.
