Marc Ouellet

Marc Ouellet specializes in litigation, and in labour, employment and administrative law.

His practice focuses mainly on proceedings for injunctive relief in general and, more specifically, in matters of unfair competition and illegal picketing, drafting of contingency plans in anticipation of a strike or lockout, on matters relating to the application and the interpretation of collective agreements and individual employment contracts, grievance arbitrations and, more generally, issues relating to the application of the various Québec employment and human rights laws (particularly the Act respecting labour standards). In addition he collaborates with Mtre Nathalie-Anne Béliveau in the drafting of the second edition of "Les normes du travail".

He represents employers in criminal proceedings relating to occupational health and safety laws.

Among his mandates, Marc obtained an injunction on behalf of an Internet service provider forcing a former employee to respect a non-compete clause; acted on behalf of an oil company at all legal stages of an important labour conflict (illegal picketing, the Labour Code's anti-strike-breaking provisions, etc.); obtained an injunction on behalf of a foodstuffs distributor forcing a soft drink manufacturer to respect a service agreement; and represented a client in a case widely covered by the media concerning the application of section 45 of the Labour Code.

He also drafts opinions and litigates before administrative tribunals and federal and provincial courts on various subjects relating to litigation, industrial relations and employment law, especially matters pertaining to compliance with limiting clauses (non-compete and non-solicitation), regularity of imposed disciplinary measures or employment relation terminations.
