- The roles of proponents, the government and aboriginal groups in the consultation process
- Who owes a duty to consult: An overview of Haida Nation v. B.C.
- Whether the government should take a back seat to proponent-aboriginal consultation
- Whether the Crown can delegate its duty to consult
Paul Wilson will be presenting " Mastering Impact Benefit Agreements: Best Practices in Structuring Aboriginal Partnerships with Proponents and Governements".
Topics to be covered will include:
- Determining what triggers an IBA
- The scope of the IBA
- Who determines which aboriginal communities should be subject to an IBA
- The role of the government in the IBA process
- Whether the IBA changes depending on surface or subsurface rights
- Whether secondary communities should be included in IBAs
- The costs of IBAs and how to apportion that cost: Should they be deducted from the royalties?
