Peter Feldberg

Peter Feldberg's practice encompasses virtually all issues related to the regulation of utilities and their infrastructure development. Over the past several years, he has acted for major western Canadian utilities on matters ranging from the implementation of electricity industry restructuring in British Columbia and the establishment of initial tariffs for a new electricity transmission company, to the resolution of First Nation issues with respect to major energy project developments. He has over 15 years of experience with Canada /US electricity matters, including commercial, jurisdictional and international law issues. He has acted as lead counsel for one of Canada's largest utilities in negotiations toward the development of a regional transmission organization in Western Canada and the Pacific Northwest, as lead counsel in the development and implementation of a Federal Energy Regulatory Commission reciprocity tariff structure in British Columbia, and with respect to arrangements to enable dynamic scheduling between western Canada and California to enhance electricity trade.

Peter currently acts as lead counsel for the applicant on electricity (ranging up to and including 500kV) and gas transmission infrastructure developments, advising and representing clients with respect to legislative and regulatory requirements, public consultation, First Nations matters, environmental assessments, siting and routing, and other matters related to contested applications and appeals. Peter also acts as lead counsel for the applicant and as intervener's counsel on a variety of revenue requirement, rate design, integrated resource planning, and other regulatory proceedings. Peter has also advised and represented utility and resource company clients on a variety of matters relating to First Nations including constitutional litigation, consultation strategies and obligations related to infrastructure development, conflict resolution, and the negotiation and drafting of impact and benefit agreements. His litigation experience extends through all levels of court, including the Supreme Court of Canada.
