The serious downturn in our real estate market has brought legal issues to the forefront which for the past 15 years or so emerged in only a small minority of cases: can the buyer rescind, is the deposit forfeit, and can the seller claim additional damages. 

This paper endeavours to identify the key legal issues for a seller facing a buyer who has collapsed the deal.
