Tracy Pratt has a diverse litigation practice. Her experience encompasses complex commercial and corporate litigation, securities litigation, corporate crime, administrative law, human rights and aboriginal law.
Tracy's securities litigation practice includes regulatory investigations and proceedings, contested mergers and acquisition transactions, corporate governance disputes and class actions. She was a member of the legal team defending OSC provincial court charges alleging misleading financial statements against a senior executive. Those charges were dismissed mid-trial. In 2001, Tracy was seconded to, and then was retained by, the Enforcement Branch of the Ontario Securities Commission. As OSC Staff, she was involved in numerous OSC investigations, proceedings and contested hearings.
Tracy also has significant experience in the growing area of aboriginal law. Her expertise includes litigation arising out of blockades, work stoppages and occupations, including injunctions and contempt proceedings. Tracy advises industry and corporate clients (particularly exploration/mining companies and municipalities) respecting aboriginal and treaty rights, government obligations and the nature, scope and requirements of the duty to consult. She has participated in various consultation tables, mediations and negotiations among industry, First Nation communities and government. She has drafted and negotiated exploration, impact and benefits and similar agreements. Tracy was co-counsel in the Platinex Inc. dispute that recently resulted in a $5 million settlement paid to Platinex by the government.
