Transportation of Dangerous Goods

The movement of dangerous goods and substances poses particular risk for organizations in the transportation industry or for those who retain their services and can be affected when those materials are not transported properly, or when accidents occur. Fasken Martineau's environmental group regularly provides advice to clients engaged in the business of transporting waste and to those who may be affected by it. We have particular expertise in relation to international and inter-provincial transportation of dangerous goods and in resolving issues of risk allocation arising from such transportation.

Recent representative experience includes the following:

• Counsel to an oil and gas company faced with a regulatory investigation arising from a sour gas leak from a tanker truck.
• Advised a chemical waste management company with respect to particular aspects of transporting dangerous material in bulk.
• Advised a U.S. fuel producer and supplier and an Alberta fuel producer and supplier as to environmental risks and potential liabilities associated with supplying fuel and how to minimize them.
