The 2016 IP Survey Report: A Temperature Check

In 2016, Fasken Martineau surveyed start-up companies, small cap companies, private large cap companies and public large cap companies to understand how they currently prioritize, develop and implement their IP strategies.

This 30-page report provides a summary and analysis of IP trends based on responses from almost 100 legal counsel, C-level and management professionals operating across a range of industries, including software, manufacturing, financial services, biotech and telecommunications.

Among the key findings:

  • Almost 10% of Large Cap (Private) respondents indicated that IP played no role within their company.
  • Most companies do not assess the value of their IP assets – making this likely the only significant asset of these companies which they do not valuate.
  • Almost 1/2 of Start-Ups and Small Caps, and over 1/3 of Large Caps (Private) and Large Caps (Public), have no IP policies.
  • More than 1/3 of Start-Ups and Small Caps, and approximately 2/3 of Large Caps (Private), have been engaged in an IP dispute.
