Despite sustained opposition from a wide range of businesses and other organizations, the Canadian government has finalized its controversial anti-spam legislation - known as Canada’s Anti-Spam Law (“CASL”) - and announced that it will be bringing the law into force starting on July 1, 2014.
CASL establishes a complex opt-in regime which regulates the use of both commercial electronic messages, and computer programs (including cookies), with serious ramifications for organizations that do business in Canada and that promote products and services to or from Canadian markets.
Given that the CASL regime touches upon multiple different subject areas, this seminar will bring together subject matter experts from technology law, privacy law, communications and litigation to provide a uniquely comprehensive review of CASL requirements, with a view to implementing effective compliance and risk management strategies which will work within an organization’s existing compliance framework.
Topics to be covered include:
- Anti-spam requirements
- Computer program/cookie requirements
- Privacy compliance implications
- CRTC Enforcement
- Litigation, Extended Liability and the Due Diligence defence
