Recent changes to securities legislation have made it easier for plaintiffs to commence class actions against mining companies. The extent of reporting obligations in the mining industry together with the use of projections and project cost sensitivity have made mining companies particularly vulnerable to being named a defendant in a securities class action. This panel will consider steps that can be taken to reduce the risk and what should be considered by a mining company if a securities class action is launched against it.
