Managing disabilities in the workplace is one of the most difficult human resources issues. Employers who fail to appropriately deal with disabilities in the workplace risk facing potentially significant liability – particularly given that employees have direct access to the Human Rights Tribunal. In this seminar, we will provide practical advice to employers and human resources personnel for managing disabilities in both unionized and non-unionized workplaces.
In this session we will:
- Examine employers’ obligations vis-a-vis employees with disabilities, including the duty to accommodate
- Review the accommodation process
- Discuss appropriate methods for dealing with uncooperative employees and treating physicians, and vague or incomplete medical documentation
- Examine at what point an employment contract becomes “frustrated” due to disability
- Review guidance from the courts as to best practices for managing disabilities in the workplace
