Representation and Warranty Insurance is increasing in popularity in Canadian M&A transactions. The insurance provides increased benefits for buyers and sellers. The product is extensively used in the United States and other markets. The Canadian market now benefits from a mature product, with lower premiums, fewer exceptions, and an efficient underwriting process. We have passed the tipping point in Canada where insurance is now a fixture in a fixture in competitive private M&A transactions.
