While the desirability of entering into Impact Benefits Agreements (IBAs) or related agreements for new projects is now quite well understood, there remains some uncertainty in industry when it comes to negotiating agreements for existing, permitted facilities. Many companies and Indigenous communities are now interested in understanding the drivers and challenges of these agreements, particularly in the energy, mining and natural resource sectors. Fasken has been at the forefront of these developments across Canada, including with our involvement in the ground-breaking work for Vancouver International Airport.
This session will discuss the increasing pressure on companies and their increasing willingness to consider negotiating IBAs for existing facilities, as well as the benefits and potential pitfalls of pursuing this course. If done well it can advance reconciliation, enhance existing relationships and set the stage for future development and expansion. Our panel will be made up of lawyers with considerable expertise in the area as well as a client who has successfully walked the path to such an agreement for an existing facility.
