There are legal and practical obstacles at every step of a cross-border matter with the potential to negatively impact an organization’s reputation, finances and legal liability. The number of multi-jurisdictional, multi-agency regulatory and criminal investigations is growing dramatically, and this session will examine how to navigate the many and often unexpected challenges of these proceedings. Determining the right approach and priority imperatives in collaboration with domestic and foreign counsel is crucial, but not always easy.

In this session, we will discuss:

  • How to avoid, plan for and respond to an investigation
  • Cross-border investigative powers and extra-territorial reach
  • Co-operating and communicating with governmental authorities
  • Expected future developments in Canada and the US
