Taking the appropriate steps in the face of a claim or potential claim is critically important, and can have a significant effect on the outcome of the eventual litigation. In-house counsel play a central role in ensuring the company takes all necessary steps to identify the important issues, protect itself and its employees, and defend the claim as successfully as possible.

In this session, external and in-house counsel will discuss, among other things:

  • Identifying and preserving relevant data and records
  • Identifying persons who may possess relevant information and evidence, and preserving that evidence
  • Strategies for investigating the issues
  • Protecting privilege wherever possible
  • Identifying potential conflicts
