Conducting effective workplace investigations has never been more important. Arising not only from #MeToo, broader employer obligations with respect to workplace harassment generally, human rights, workplace safety, mis-use of corporate technology and white collar crime, mean that prompt and effective investigations will allow management to respond to complaints, identify big issues in the work environment and resolve problems at an early stage. Effective investigations also reduce the likelihood of litigation and increase the chance of success if it cannot be avoided. This seminar will provide an overview of the latest law on investigations, best practices and the role of in-house counsel. Topics will include:

  • Impact of Ontario’s Bill 132 and other recent legal developments
  • Planning the investigation’s scope and resources
  • Lawyer-client privilege and the appropriate role of in-house counsel
  • When to use external investigators – ethical and practical considerations
  • Protecting & searching electronic records
  • The investigation process – best practises
  • Investigative interviews
  • Avoiding reprisal complaints
  • Effective report writing
  • Credibility determinations
  • Reporting to the complainant and the respondent
