Godfrey Malesa is a mining lawyer in Fasken’s Johannesburg office and a member of the Global Mining Group.
Leveraging his in-depth knowledge of the Mineral and Petroleum Resources Development Act, Godfrey ably advises clients on all aspects of mining regulatory work and transactional issues, including compliance, prospecting and mining right applications, appeals, judicial reviews and surface use issues.
Godfrey’s expertise also includes advising on commercial arrangements, equity and asset acquisitions, due diligences investigations, opinion work and Black Economic Empowerment transactions.
His experience further includes the law applicable to traditional communities and traditional leadership, including traditional communities’ structures, and corporatization of traditional communities’ commercial affairs.
Godfrey also has experience in general corporate and commercial law work, including conducting due-diligence investigations and drafting contracts including contract mining agreements, surface lease agreements, memorandums of incorporations, shareholders’ agreements, sale of share agreements, subscription and agreements.
He also has experience in advising clients on administrative law, including reviews of administrative decisions and disputes relating to state procurement.
