Jean H. Gagnon is a mediator, arbitrator and counsel.
Jean H. Gagnon has more than 40 years of experience as a mediator and arbitrator for the resolution difficulties and disputes between businesses, shareholders, partners, entrepreneurs, managers and professionals, as well as within business families. He is an accredited mediator (by the Barreau du Québec and the Institut de médiation et d'arbitrage du Québec) and an accredited arbitrator (by the Institut de médiation et d'arbitrage du Québec). He is recognized by his peers for his integrity, his ability to listen and his determination to seek practical and realistic solutions. He also has an exceptional understanding of business issues and non-judicial methods of resolving business disputes.
He also has extensive expertise in the design and implementation of non-judicial dispute resolution mechanisms, as well as in the drafting of appropriate clauses to that effect.
Jean also has over 47 years of experience in the areas of franchising and other forms of strategic business partnerships, pharmacy law and drug distribution. For several decades, he has been recognized in many renowned legal directories as one of the best lawyers in Canada in these fields.
In 2011, he was awarded the title of Lawyer Emeritus (Ad.E.) by the Barreau du Québec, an honour reserved for lawyers known for their outstanding professional career, outstanding contribution to the legal profession, or outstanding social and community standing that has brought honour to the legal profession.
He was the first inductee in the "Builders" category to the Franchise Hall of Fame (2011), received the "2006 Tribute Award for a Non-Franchisor Member" from the Canadian Franchise Association, the title of "Honorary Member" awarded by the Federation of European Partnership and Franchise Networks (Paris, 2006), the "Tribute Award" from the Conseil québécois de la franchise (2002), and the "Small Business Showcase Prize" (1983). In 2018, he also received a special award from the Conseil québécois de la franchise for his "exceptional contribution to the franchise industry".
Mr. Gagnon has completed specialized studies in negotiation and mediation (including three intensive sessions at Harvard University).
He is the author of 20 books and countless texts, articles, courses, sessions and seminars on franchising, shareholders’ or partners’ relationships and disputes, negotiation, mediation and arbitration.
